Law Enforcement SB1485 (Mike Bell) Prohibits any state or local law enforcement officer from participating in a voluntary motor vehicle checkpoint conducted by a private company or research institute for the purpose of collecting human DNA samples, to be used for research, from consenting motorists stopped at the checkpoint.

thumbsupGuns in parks SB1496 (Stacey Campfield) / HB1407 (Tilman Goins) Deletes provisions authorizing local governments to prohibit carrying handguns in parks by resolution or ordinance; allowing a person with a handgun carry permit to carry a firearm in any state, county, municipal park, or other recreation area. The Tennessee Municipal League, the leading lobbyist for the cities have opposed this bill and were the leading advocates in installing this into the TCA code several years ago. Mayor Jerry Gist of Jackson attempted to use his position to enact this measure in the city as well break state law by providing police service in a gun buy back program lead by Councilman Scott Conger, LANA and the local NAACP.

Criminal Law: Permit holders to update address electronically. Requires the department of safety on or after January 1, 2014, to provide a method for permit holders to notify the department electronically of a change in residence. HB379J. SB 1182 Campfield (HB 1018 by *Evans) Employees, Employers – As introduced, prohibits employers from inquiring about an applicant’s lawful ownership of a firearm; prohibits an employer from conditioning employment on lawful ownership of firearm; confers immunity on businesses when permit holders store firearms in vehicle on business parking lot. – Amends TCA Title 39. This one I am not sure about….

SB 1486 Bell (HB 1539 by *Brooks K) Banks and Financial Institutions – As introduced, allows industrial loan and thrift companies to charge a convenience fee for accepting payment through electronic means. – Amends TCA Section 45-5-403.

SB 1505 *Johnson (HB 1442 by *Lamberth) Corporations, Not for Profit – As introduced, revises laws relating to non-profit corporations. – Amends TCA Title 48.3.

SB 0880 *Tracy (HB 1005 by *Kane, Haynes, Eldridge, Matlock) Insurance Companies, Agents, Brokers, Policies – As introduced, makes various changes concerning coverage of sinkhole losses and subsequent structural repair. – Amends TCA Section 56-7-130. 4.

SB 1350 *Yager (HB 1247 by *Keisling) Insurance Companies, Agents, Brokers, Policies – As introduced, reduces the time period that commercial lines insurance insurers have to furnish a requesting insured with a loss run history and subjects insurers violating the time-period to certain penalties. – Amends TCA Title 56.

STATE AND LOCAL GOVERNMENT

HJR 0051 Hardaway General Assembly, Directed Studies – Directs the secretary of state in consultation with the department of education to biennially develop online K-12 curricula based on the Tennessee Blue Book.

SB 1082 *Kyle (HB 0252 by *Jernigan, Pitts) Election Laws – As introduced, allows any photo identification issued by public institution of higher learning to be used as evidence of identification for voting purposes. – Amends TCA Title 2, Chapter 7.
