Denver Public Schools Drops ICE Lawsuit

Denver Public Schools (DPS) has agreed to dismiss its lawsuit against the Department of Homeland Security (DHS), the district announced Tuesday.

Filed in February, the lawsuit sought to reinstate a rescinded Biden-era policy prohibiting federal immigration enforcement at schools and other “sensitive locations.”

Though DPS didn’t win the lawsuit, the district declared “a victory” in the case because DHS admitted its new policy, which was previously unpublished, hadn’t “fundamentally changed” from the old one. DPS said it would refile the lawsuit “should circumstances change” or should any immigration enforcement action be taken on school property or near a school.
