Judge Orders ICE Not to Deport Vizguerra

A federal judge issued an injunction on Friday to prevent Immigration and Customs Enforcement (ICE) from deporting Jeanette Vizguerra, the immigration activist detained by ICE last week.

Vizguerra’s lawyers had filed a writ of habeas corpus and a petition for review with the Tenth Circuit Court of Appeals, challenging ICE’s authority to detain and deport her. Friday’s ruling prohibited Vizguerra’s deportation pending a decision by the court.

ICE earlier stated that Vizguerra, who illegally entered the U.S. in 1997, “has a final order of deportation” and has already “received legal due process in U.S. immigration court.”

Vizguerra is scheduled to appear in federal court on March 28. The judge says the case “raises complex issues” about the legality of her arrest.
