New York judge Juan Merchan is set to decide on Tuesday whether President-elect Donald Trump’s so-called “hush money” conviction will be overturned in light of a U.S. Supreme Court ruling on presidential immunity.
The U.S. Supreme Court ruled in July that former presidents can’t be prosecuted for actions related to their core presidential powers.
Merchan will also decide whether to sentence Trump on Nov. 26 as currently scheduled, though experts suggest a sentence before his inauguration is unlikely. Trump’s conviction in this case is one of four legal battles to which the President-elect has pleaded not guilty. The Justice Department is currently reviewing how to wind down the other federal cases.
